1. German Federal Patent Court rules that a nullity action against the German part of a European patent is not admissible even if the nullity action is based on grounds of revocation which cannot be raised in the parallel opposition proceedings pending against the European patent "Torasemid" "Torasemide" 3 Ni 7 [EU] ; . According to Section 81 2 ; German Patent Act, a nullity action against the German part of a European patent is inadmissible as long as parallel opposition proceedings against the European patent are pending "Principle of Subsidiarity" ; . Attorneys of the law firm Bardehle Pagenberg successfully represented the patentee in its claim that this legal provision also applies if an invalidation ground is raised in the nullity action which cannot even be raised in the parallel opposition proceedings. The appeal is currently pending before the Federal Supreme Court. In the decided case, the patentee had limited the German part of a European patent after grant by means of a limitation request, which is a unique possibility in Germany in order to limit a patent in ex parte proceedings Section 64 German Patent Act ; . An alleged infringer lodged an opposition against the European patent as well as a parallel nullity action against its German part. The nullity action was based on the argument that the feature which has been used to limit the German part of the European patent lacks disclosure in the application documents as originally filed. The plaintiff argued that a nullity action is admissible in spite of the pending opposition proceedings contrary to Section 81 [2] German Patent Act ; , because the ground of lacking original disclosure only applies to the limited ; German patent, but not to the European patent which allegedly does not contain the respective feature. Therefore, the danger of contradicting decisions is excluded. Further, there is a need for parallel nullity proceedings: The claim amendment resulted in the scope of protection "coming closer" to the alleged infringing embodiment. How-ever, due to the opposition proceedings a nullity action is blocked for a time period of up to five years if Section 81 2 ; German.

Even though patients undergoing gynaecological laparoscopy are considered to be at particular risk of gastric aspiration, 1 the laryngeal mask airway LMA ; has been used successfully with a low incidence of regurgitation.2 However, Owens and colleagues3 have shown the use of the LMA to be associated with an incidence of gastro-oesophageal reflux GOR ; of 54% in spontaneously breathing patients. They suggested that a decrease in lower oesophageal sphincter barrier pressure by the LMA4 together with an increase in resistance to breathing with a greater negative intrathoracic pressure during inspiration, may promote GOR. Roberts and Goodman5 did not detect any episode of GOR in 63 patients who underwent gynaecological laparoscopy. All of their patients underwent ventilation via a tracheal tube. There is a paucity of data comparing the effect of spontaneous breathing with positive pressure ventilation PPV ; using the LMA in patients undergoing gynaecological laparoscopy. In this study, we have determined the incidence of GOR with the LMA in this "at risk" group of patients and investigated if breathing spontaneously was associated with a higher risk of GOR compared with PPV.

The distinct enantioselectivity of PHX metabolism displayed by PMs in vivo Inglis et al., 2006 ; may be due to extrahepatic metabolism, non-P450 metabolism, or transporters involved in absorption, renal, biliary, or intestinal excretion, and merits further investigation. CYP3A is the most abundant P450 in the liver Shimada et al., 1994 ; and is composed primarily of CYP3A4, except in approximately one quarter of Caucasians carrying at least one CYP3A5 * 1 allele, where CYP3A5 constitutes at least half of the total hepatic CYP3A Lin et al., 2002 ; . CYP3A5 may be involved in PHX metabolism because CYP3A4 and CYP3A5 have similar substrate specificity Gillam et al., 1995 ; , and the 3-fold range in the oral clearance of five PMs observed by Sallustio et al. 2002 ; may be due to interindividual differences in CYP3A expression Lin et al., 2002 ; . CYP2B6 shares regulatory features with CYP3A4 Rodriguez-Antona et al., 2000 ; , and its expression is also highly variable Stresser and Kupfer, 1999 ; . Cyclic Voltammetric Studies of Arylisocyanidecobalt I ; Complexes with Tertiary Phosphine Ligands Clifford A.L. Behaviour ranges from reversible to irreversible. Several distinct trends emerge. The Eox values systematically increase as substituents in the arylisocyanide ligand progress from electron-donating to electron-withdrawing. Sometimes this trend is reversed, possibly attributable to steric hindrance. The Eox values also systematically increase as the tertiary phosphine ligand becomes weaker -donating stronger * accepting due to substituents. Trialkylphosphines show weaker -acidity than triarylphosphines, except with electron-withdrawing substituents, like P CH2Ph ; 3 and P CH2CH2CN ; 3. Cobalt I ; complexes of 4: 1 arylisocyanide: tertiary phosphine ligand composition tend to have substantially higher Eox values than 3: 2 complexes with identical arylisocyanide and tertiary phosphine ligands. Key Words: Cyclic voltammetry, Arylisocyanides, Cobalt I ; , Triarylphosphines, Trialkylphosphines.

Financial instruments In January 2005, the CICA issued four new accounting standards in relation with financial instruments: section 3855 "Financial Instruments Recognition and measurement", section 3865 "Hedges", section 1530 "Comprehensive Income" and section 3251 "Equity". Section 3855 expands on section 3860 '' Financial Instrument - Disclosure and Presentation'', by prescribing when a financial instrument is to be recognized on the balance sheet and at what amount. It also specifies how financial instrument gains and losses are to be presented. Section 3865 provides alternative treatments to section 3855 for entities which choose to designate qualifying transactions as hedges for accounting purposes. It replaces and expands on Accounting Guideline AcG-13 "Hedging Relationships", and the hedging guidance in Section 1650 "Foreign Currency Translation" by specifying how hedge accounting is applied and what disclosure is necessary when it is applied. Section 1530 "Comprehensive Income" introduces a new requirement to temporarily present certain gains and losses outside net income. Consequently, Section 3250 "Surplus" has been revised as Section 3251 "Equity.

Cute efficacy of antidepressant medications is well established 1, 2 ; . Following acute treatment, continued medication seems indicated for at least 6 months, since earlier discontinuation increases the risk of relapse 3, 4 ; . The first 4 to 6 months following remission of symptoms are arbitrarily considered continuation therapy, and return of symptoms is considered a relapse of the index episode. After 6 symptomfree months, treatment is called maintenance; new symptoms during this time are deemed a new episode i.e., recurrence ; 5 ; . Questions arise as to whether treatment should continue beyond 6 months and whether findings in one depressive subtype also apply to other subtypes and aminophylline.
